Who we are:

The Right to Build Register is owned and operated by BuildStore Custom Build LTD T/A Custom Build Homes (CBH), the leading UK Enabler for serviced building plots.

Definitions

“The Right to Build Register” or ”RTBR” means the register platform created by CBH for information provided through the voluntary completion of a questionnaire.

“Personal Data” relates to any information to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly. This definition is the definition provided by the General Data Protection Regulation (GDPR).

How the law protects you

This privacy notice explains your privacy rights and how the law protects you. This notice is to let you know how Custom Build Homes promise to look after your personal information. This information includes personal and non-personal data which is collected and hosted on the Right to Build Register Platform (see section “What data do we collect?”).

In accordance with GDPR and your ‘Right to be Informed’ Our privacy policy covers the following aspects:

What data we collect?

The information we collect about you is used solely for the purposes for which it was provided. We only use it for additional purposes (such as marketing) if we have received your consent to do so.

The Right to Build Register will collect personal and non personal data and will include the following categories:

  • Full name;
  • Email address;
  • Date of birth;
  • Age (which age group are you in);
  • Nationality/citizenship;
  • Contact information such as telephone number and address details;
  • Demographic information including address details, number of adults and children in your household;
  • Interests relating to custom and self build (for example a serviced plot to build a house for a main residence);
  • Details of your local authority preferences, including the property types you are interested in for self and custom build plots;
  • Information you’ve provided in respect of evidencing a local connection to your chosen local authority, where you are interested in building, including where you live and work or whether you have any family members there;
  • Personal and financial documentation when required to complete any registration with a specific local authority area.
  • Supporting documents you may upload in your document library to support your application, including proof of affordability or evidence of a local connection.
  • IP address, web browser type and version.

We may also collect information from you from the way that you engage with us:

  • When you apply for our products and services
  • When you talk to us on the phone, our offices or at shows and exhibitions
  • When you use our websites, webforms and web chat
  • In emails and letters
  • In financial reviews and interviews
  • In customer surveys
  • If you take part in competitions or promotions

We will not sell your personal information to any third parties.

Along with our business and internal computer systems, our websites use SSL (Secure Socket Layer) to protect the details you send us. This is a standard security technology for establishing an encrypted link between our server and you the client. When you enter your personal details on any of Custom Build Homes’ websites, or in this case, the Right to Build Register, you are entering these within a secure environment.

In most web browsers, a padlock symbol appears at the beginning of the website along with https at the beginning of the web address indicating you are in a secure environment.

 

How we use your personal data

All personal data processed on the Right to Build Register will be held securely and will not be held longer than is necessary for the purpose for which it is intended. We will ensure that the appropriate organisational and technical measures are always in place to safeguard your data in line with the GDPR regulations.

Our lawful basis for processing, is proportionate to achieving our specific purpose of delivering a service to you in which you will have given your expressed consent to our use of your personal data.

Our legitimate interests mean your data may be used for one or more of the following purposes:

  • Your personal data may be shared with the local authorities in the areas you have registered your interest.
  • Your personal data may be used by the BuildStore Group to keep you informed of products and services which directly relate to supporting you achieve a custom or self-build home.
  • Your Personal Data may be shared with an external local broker on occasions where it is necessary to evidence Financial Documentation to complete any registrations with a local authority which imposes this form of Test.
  • Your Personal data may be shared with the Ministry of Housing, Communities and Local Government

We also use your data in big data projects to help us understand trends in the marketplace. We may occasionally send you marketing emails containing special offers and promotions from us and our approved business partners. We store our information on our servers in the UK. We also may store your information with our cloud service providers, located in Bristol and Newport in the UK. We use cookies to monitor your behaviour when you are on our websites including details of how you clicked through to our sites, how long you spend on each pages of our sites and whether you respond to any pop-up ads we may send to you on our sites.

 

Change of purpose

We will only use your personal data for the purposes stated above unless we consider it necessary to use it for another reason and it is compatible with the original purpose.

If we need to use your data for an unrelated purpose, we will notify you and explain the legal basis which allows us to do so. We may process your personal data without your knowledge or consent, where this is permitted and required by law.

Who we share your personal information with

 

The personal information you provide will not be passed to any third-party organisations for marketing purposes.

We disclose personal information to third parties such as local authorities, estate agents, property and land developers, lenders, brokers, protection product suppliers, and Custom Build Homes employees but only what is necessary for the conclusion and ongoing servicing of a contract, for example mortgage and/or protection contracts.

It may also be necessary to share your personal information with non-affiliated companies who perform support services on our behalf including those that provide professional, legal IT or accounting advice to Custom Build Homes.

These companies are required to ensure appropriate security measures are in place and maintain the confidentiality of your information and to use your personal information only while providing such services as specified by Custom Build Homes.

How long is your personal information retained?

We will retain your personal information in accordance with applicable laws and while a client relationship is in place, for example if you have opted into a newsletter to find out more about self and custom build opportunities, we will retain your data for as long as we are offering these services.

 

When registering your details on the Right to Build Register, we will hold your information in accordance with applicable legislation which relates to self and custom build obligations for local authorities as outlined in the Self Build and Custom Housebuilding Act 2015.

The Financial Conduct Authority (FCA) requires data to be kept for 6 years from the date of full self or custom build applications. Your information will be retained for no longer than is necessary to manage your relationship with us, however we will continue to hold some information for a period of time after your relationship has ended in order to comply with our legal and regulatory obligations to keep records of our relationship, to resolve disputes or where it may be needed for future legal proceedings.

Individual Rights

As a data subject, you have the following rights under the GDPR regulations:

Right of Access

You have a right to access your personal data and supplementary information. Right of access allows you to be aware of and verify the lawfulness of how we process your data.

Under GDPR, you have a right to obtain:

1.      Confirmation that your data is being processed

2.      Access to your personal data; and

3.      Other supplementary information

There is no fee charged to access your personal data and supplementary information.

When you request access to your personal data, we will acknowledge receipt of your email or request by mail and will provide you with the information within one month of receipt of this request.  In the case of complex or numerous requests, we have a right to extend this period.  We will notify you if this is the case with your request and explain the reason why this extension is necessary.

Right to be Informed

You have the Right to be informed about the information we provide you about what we do with your personal data. We must actively provide you with this information in a way that is easy to access, read and understand. We must also inform you of our retention periods of your data and who it will be shared with. Right to Rectification

Right to Erasure

Under GDPR, you have a right to erasure. This means you can request the deletion or removal of your personal information where there is no compelling reason for its continued processing.

We will acknowledge receipt of your request to remove your personal information and confirm action of this request within one month. If you have used one of BuildStore’s services that is regulated by the Financial Services Conduct Authority, right to erasure does not apply.

You should be aware that should you wish to exercise your right to erasure you will be removed from the Right to Build Register and this may result in your application to a local authority being removed or refused resulting in you not having exercised your Right to Build.

 

Right to Restrict Processing

You have a right to restrict processing of your personal data. This allows us to suspend the processing of your personal data in the following circumstances:

1.      Where the accuracy of your personal data is in question, you have a right to restrict the processing until we have verified the accuracy of the personal data

2.      Where you have objected to the processing of your personal information but we need to verify whether we have an overriding legitimate grounds to use it

3.      Where you require us to hold the data even if we no longer require it as you need to establish, exercise or defend legal claims

 

Right to Data Portability

The Right to Data Portability allows you to obtain and reuse your personal data for your own purposes across different services.  It allows you to move, copy or transfer personal data easily from one IT environment to another in a safe and secure way, without hindrance to usability.

Please note that this information only applies to automated information where you have given us your consent to us to use or where we’ve used your information to enter a contract with you.

 

Right to Object

The Right to Object allows you to object to the processing of your personal data under the following circumstances:

1.      Where we are relying on a legitimate interest or the performance of a task in the public interest

2.      Where the processing of your personal data is used for direct marketing purposes (including profiling)

3.      Where the processing of your personal information is used for purposes of historical research and statistics.

 

Marketing Communications

Custom Build Homes reserves the right to market to you through the use of your personal data under legitimate interests.

You will have the choice to opt-in to receive other marketing related information regarding our products and services. You can opt out of these emails at any time by clicking on the link at the bottom of your email.

We will still be required to send you emails regarding servicing information in connection with your Right to Build registration and services that we provide you.

 

Your personal information will not be passed onto any third-party organisation for marketing purposes.

Withdraw Consent

You have a right to withdraw consent at any time when we need your consent to process your personal data. This will not affect the lawfulness of any processing which has taken place before you withdraw your consent. If you choose to withdraw your consent, we will not be able to inform you of products or services. We will advise you if this is the case at the time you withdraw your consent.

Please note that if you withdraw your consent, this may mean that you can no longer be determined for eligibility onto the Right to Build Register and will mean that your application can no longer be considered.

 

Data Security

We have appropriate security measures in place to prevent your personal data becoming accidentally lost, used, and accessed in an unauthorised way, altered or disclosed.

We also limit access to your personal data only to those Custom Build Homes staff, appointed representatives, advisers, business partners and suppliers who have a business need to know. Your personal data will only be processed on our authority and they are held to a duty of confidentiality.

When using our websites, you can set your browser to refuse all or some browser cookies. If you decide to disable or refuse cookies, please note that some parts of our website may become inaccessible or not function properly. The length of time in responding will depend on the type and complexity of your request, but we will issue a response no later than one month from your initial request.

If you are still not satisfied how BuildStore Group has responded to your enquiry you have a right to complain to the Information Commissioner’s Office (ICO), who is the regulator for data protection in the United Kingdom.
